1. Terms of Service (formal)

1. Acceptance of Terms

By accessing or using the madescene service (“Service”), provided by madescene (the “Company”, “we”, or “us”), you accept and agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms are effective as of the date above.

2. Eligibility; Age restriction

You must be 18 years or older to use the Service. By using the Service you represent and warrant that you are at least 18 years of age.

3. Account & Registration

3.1. You may be required to create an account to access portions of the Service. You agree to provide accurate information and maintain your credentials securely. 3.2. You are responsible for all activity that occurs under your account. Notify us immediately of unauthorized use.

4. Scope of Service; No Professional Advice

4.1. madescene provides an AI-powered conversational assistant and tools to create interactive “scenes” (simulations) from user input. The Service is intended for educational and entertainment purposes. 4.2. The Service does not provide medical, legal, financial, safety-critical, or other professional advice. The LLM may produce inaccurate, incomplete, or harmful information. You must not rely on madescene as a substitute for professional judgment.

5. Scenes (simulations) and accuracy

5.1. Scenes are generated algorithmically and may be inaccurate or non-functional. We make no promises about the correctness, completeness, or outcome of scenes. 5.2. You accept that scene accuracy, reliability, and performance vary. Use scenes at your own risk.

6. Content & Uploads

6.1. You may input text and optionally upload images (camera or photo) for use with the Service. You are solely responsible for the content you submit, and for ensuring you have all rights to any content you upload. 6.2. By submitting content, you grant the Company a limited, non-exclusive, worldwide, royalty-free license to use, store, process, and display that content as necessary to provide the Service and for internal analytics and service improvement, unless otherwise described in the Privacy Policy.

7. No Sharing / User Isolation / Prohibition on Extraction

7.1. Accounts, conversations, and scenes are private and isolated. Sharing scenes, exporting conversations or otherwise distributing Scenes created in-app to other users or external parties is not permitted through the Service. 7.2. Attempting to circumvent isolation, reverse-engineer, extract, scrape, or otherwise access other users’ scenes or in-app data is strictly prohibited. Such attempts may result in immediate account suspension or termination and may expose the actor to civil or criminal liability.

8. Prohibited Conduct

You must not use the Service to:

• Violate laws or encourage others to do so.
• Generate content that is unlawful, hateful, sexually explicit, or abusive in violation of our Acceptable Use Policy.
• Promote self-harm, the fabrication of medical diagnoses, or unverified safety-critical instructions.
• Attempt to access or interfere with other users’ accounts, data, or the Service infrastructure.
• Reproduce or redistribute the Service outputs in ways that violate these Terms (including prohibited extraction, scraping, or public posting of other users’ Scenes).

9. Intellectual Property

9.1. The Company retains all rights, title and interest in the Service, the LLM model outputs as offered by the Company, the interface, and the platform. 9.2. Unless otherwise stated in the Privacy Policy or a separate agreement, you retain ownership of your original user inputs; you grant the Company the rights set out in Section 6.

10. Fees and Billing

10.1. The Service offers a limited free plan/trial period and paid subscription tiers. Paid plan details (pricing, features, billing) are available in-app and on the landing page. 10.2. All fees are non-refundable except as required by applicable law or at Company discretion.

11. Disclaimers; Limitation of Liability

11.1. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 11.2. THE COMPANY IS NOT RESPONSIBLE FOR DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, OR INCIDENTAL DAMAGES ARISING FROM USE OF THE SERVICE, INCLUDING HARM CAUSED BY RELYING ON MODEL OUTPUTS OR SCENES. YOU USE THE SERVICE AT YOUR OWN RISK.

12. Indemnification

You agree to indemnify, defend and hold harmless the Company from any claim, loss, liability, damage, or expense (including reasonable attorneys’ fees) arising from your misuse of the Service, violation of these Terms, or infringement by your content.

13. Account Termination & Remedies

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion. We may pursue legal remedies in cases of prohibited extraction, hacking, or other unlawful acts.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the jurisdiction indicated in Company settings (update as appropriate). Disputes will be handled as described in Company settings; consult legal counsel to pick a governing law and venue.

15. Changes to Terms

We may update these Terms. We will provide notice where required. Continued use after notice constitutes acceptance of the updated Terms.

• Repeated or severe violations: account suspension, termination, and possible referral to law enforcement.

3. Safety Guidelines (user-facing, plain language)

Use smartly and safely — short tips

• You must be 18+ to use madescene.
• Don’t share sensitive info (SSNs, full credit card numbers, private medical records) with the AI. The model and logs may store data to provide the service — read our Privacy Policy.
• Don’t rely on the AI for professional decisions. For medical, legal, financial, or safety-critical decisions, consult a qualified human professional.
• Scenes can be wrong or broken. Test and verify all outputs before using them for study, teaching, or demonstrations.
• Uploads are optional. If you upload photos or data, make sure you own or have permission to use them.
• Respect others. madescene does not provide channels to contact other users — the tool is single-user and private.
